Highlights:
- As part of Canada's commitment to family reunification, Open work permits are now available for Outland applications.
- IRCC aims to process spousal sponsorship applications within 12 months.
Outland sponsorship enables foreign nationals living abroad to be sponsored by their Canadian spouse or partner for permanent resident (PR) status in Canada. Unlike Inland spousal sponsorship, Outland sponsorship does not require the couple to reside together in Canada.
This is a great move by IRCC that makes it possible for more families to be together. Initially, the open work permits were only available for applicants through Inland sponsorship, who were already residing in Canada on temporary resident visas.
Who is Eligible to Apply for Open Work Permit Under Outland Sponsorships?
To be eligible to sponsor a loved one under the Outland application category, both the sponsor and sponsored person will have to meet a number of specific requirements:
- The sponsor must be a Canadian citizen or permanent resident.
- Both the sponsor and the sponsored person must be at least 18 years old.
- The relationship between the sponsor and the sponsored person must fall into one of the following categories: Spouse, Common-law partner, or Conjugal Partnership.
- The sponsor must not have sponsored a spouse in Canada in the five years prior to the application.
- Neither spouse should be in prison, charged with a serious offense, or bankrupt.
- If the relationship falls under the category of a conjugal partnership, the application must be submitted under the Outland sponsorship, as this type of relationship is not eligible for Inland sponsorship.
A new temporary policy was released by IRCC for spousal open work permit eligibility on Jan 30, 2023. Get all the details.
